Terms of Service

These Terms of Service ("Terms") govern your use of the Bloom platform and services provided by Bloom Software Pty Ltd (ABN 81 680 336 145) ("Bloom", "we", "our", or "us").
By accessing or using Bloom, you agree to be bound by these Terms. If you are using Bloom on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
Acceptance of Terms
By creating an account, accessing the Bloom platform, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use Bloom.
Service description
Bloom is an AI-assisted clinical documentation platform designed to help healthcare professionals with transcription, note generation, and practice management.
The service includes:
- Audio recording and transcription
- AI-assisted clinical note generation
- Document templates and editing
- Practice management features (patients, appointments, calendar)
- EMR integrations where available
Features may be added, modified, or removed at our discretion. We will provide reasonable notice of material changes.
Regulatory status
Bloom is an administrative software tool designed to reduce the time healthcare professionals spend on clinical documentation tasks such as writing notes, letters, and referrals.
Bloom is not intended to diagnose, treat, cure, or prevent any disease or medical condition. It does not provide clinical decision support or diagnostic recommendations.
As such, Bloom is not classified as a medical device and falls outside the regulatory scope of the Australian Therapeutic Goods Administration (TGA).
Eligibility
Bloom is intended for use by:
- Registered healthcare professionals
- Healthcare organisations and practices
- Authorised staff members of healthcare organisations
By using Bloom, you represent that you are a healthcare professional or are authorised to use the service on behalf of a healthcare organisation.
Accounts
Organisation accounts
Bloom operates on an organisation-based model. When you create an account, you create or join an organisation. The organisation is responsible for managing users, billing, and compliance with these Terms.
User roles
Bloom supports multiple user roles:
- Owner: Full administrative access, billing management
- Doctor: Clinical documentation and patient access
- Staff: Administrative access as configured by the organisation
Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
Customer content
Ownership
You retain ownership of all content you create, upload, or generate using Bloom ("Customer Content"), including audio recordings, transcripts, clinical notes, and documents.
License to Bloom
You grant Bloom a limited license to process, store, and transmit Customer Content solely for the purpose of providing the service to you.
Patient consent
You are responsible for obtaining appropriate consent from patients before recording consultations or entering their information into Bloom.
Bloom provides tools to support documentation workflows, but the responsibility for patient consent and compliance with healthcare regulations remains with you and your organisation.
AI services
Important: Clinical responsibility
Bloom's AI features assist with documentation only. The final responsibility for all professional and medical decisions - including the accuracy and completeness of clinical notes - rests solely with the healthcare practitioner.
By using Bloom's AI features, you acknowledge and agree:
- AI-generated content may contain errors, omissions, or inaccuracies
- You must review and verify all AI outputs before use in clinical practice
- AI outputs do not constitute medical advice, diagnosis, or treatment recommendations
- All clinical and professional decisions remain your sole responsibility
- Bloom does not replace your professional training, expertise, or judgment
Regarding your data and AI:
- Customer Content is not used to train AI models
- AI providers are contractually prohibited from using your data for training
- Processing is performed under strict confidentiality obligations
Acceptable use
General prohibitions
You agree not to:
- Use Bloom for any unlawful purpose
- Attempt to gain unauthorised access to Bloom or its systems
- Reverse engineer, decompile, or disassemble the service
- Interfere with or disrupt the service or servers
- Share account credentials with unauthorised users
- Use automated systems to access Bloom without permission
- Resell or redistribute the service without authorisation
AI-specific prohibitions
When using Bloom's AI features, you must not:
- Input intentionally false, misleading, or fabricated information
- Attempt to manipulate AI outputs for purposes other than clinical documentation
- Use AI features to generate clinical diagnoses or diagnostic recommendations
- Rely on AI outputs without appropriate clinical review and verification
- Use AI-generated content in ways that misrepresent its origin or nature
We reserve the right to suspend or terminate accounts that violate these terms.
Subscription and billing
Pricing
Bloom is priced per healthcare provider seat. Staff accounts are provided at no additional cost. Current pricing is available on our website.
Free trial
New organisations may be eligible for a free trial period. At the end of the trial:
- If a payment method is on file, the subscription will automatically convert to a paid plan
- If no payment method is on file, access will be restricted until payment is provided
Billing cycle
Subscriptions are billed monthly. Payments are processed through Stripe. You authorise us to charge your payment method on a recurring basis.
Price changes
We may change pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.
Cancellation
Organisation Owners can cancel their subscription at any time through the subscription settings page in the application.
Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- No refunds are provided for partial billing periods
- After the subscription ends, your account will have read-only access to your data
You may export your data at any time while you have access to the platform.
Intellectual property
Bloom and its original content, features, and functionality are owned by Bloom Software Pty Ltd and are protected by copyright, trademark, and other intellectual property laws.
System templates provided by Bloom are licensed for your use within the platform. Custom templates you create belong to your organisation.
You may not copy, modify, distribute, sell, or lease any part of our service or included software without our written permission.
Third-party services
Bloom integrates with third-party services including EMR systems and payment processors. Your use of these integrations may be subject to additional terms from those providers.
We are not responsible for the availability, accuracy, or content of third-party services.
Service availability
We strive to maintain high availability but do not guarantee uninterrupted access to Bloom. The service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide reasonable notice)
- Unscheduled maintenance or emergency repairs
- Factors beyond our reasonable control
We recommend maintaining your own clinical documentation backup procedures.
Limitation of liability
To the maximum extent permitted by law:
- Bloom is provided "as is" without warranties of any kind
- We do not warrant that the service will be error-free or uninterrupted
- We are not liable for any indirect, incidental, special, or consequential damages
- Our total liability is limited to the fees you paid in the month preceding the claim
Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
Indemnification
You agree to indemnify and hold harmless Bloom Software Pty Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, violation of these Terms, or infringement of any third-party rights.
Termination
Either party may terminate the agreement at any time. We may suspend or terminate your access immediately if you breach these Terms.
Upon termination:
- Your right to use the service will cease
- You will have read-only access to export your data
- We may delete your data after a reasonable period following termination
Sections relating to intellectual property, limitation of liability, indemnification, and governing law will survive termination.
Governing law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Changes to these Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or through the application.
Continued use of Bloom after changes take effect constitutes acceptance of the revised Terms.
